MyRacing Terms of Service

Welcome to MyRacing. These Terms of Service ("Terms") govern your access to and use of the MyRacing web application (app.myracing.online) and mobile applications (iOS and Android), collectively the "Service". Please read these Terms carefully. If you do not agree, you may not use the Service.

1. Definitions

"Service" refers to the MyRacing web application, mobile applications (iOS and Android), and all features and functionality provided.
"Operator", "we", "us" refers to Cottage 13 Katarzyna Brodzka-Demianiuk (NIP: 5262197414, REGON: 527220630), registered at Chlina 13, 42-439 Zarnowiec, Poland, operating under the MyRacing brand.
"User", "you" refers to any individual accessing or using the Service.
"User Data" refers to data you input into the Service, including session records, motorcycle setups, tire information, lap times, and related racing data.

2. Account Registration and Security

2.1 Account Creation

To use certain features you must register for an account, providing accurate and current information. You may register via email/password or Google Sign-In.

2.2 Account Security

You are responsible for your account credentials and all activity under your account. Notify us immediately at contact@myracing.online of any unauthorised access.

2.3 Age Requirements

You must be at least 16 years old to use this Service.

3. Service Description and Licence

3.1 Service Description

MyRacing provides motorcycle racing data management tools including: session tracking and analysis, motorcycle setup management, tire management, lap time recording, spare parts inventory, maintenance tracking, endurance race strategy planning, AI-powered racing assistance (Pro required), weather integration, and data sharing with mechanics and team members.

3.2 Licence Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal or professional racing-related activities.

3.3 Restrictions

You may not: sublicense, sell, or distribute the Service; reverse engineer or build competitive products from it; use it for unlawful purposes; share account credentials; or scrape data using automated tools.

4. Subscription Plans and Payment

4.1 Free Plan

The Free Plan is provided at no cost and includes:

1 motorcycle
Up to 5 saved setups
Up to 10 document uploads
Up to 50 tires
Up to 5 spare parts
Session tracking, tire and setup management, maintenance tracking, spare parts inventory, endurance race planning, and basic analytics

4.2 Pro Subscription

Pro subscriptions provide:

Unlimited motorcycles, setups, and documents
AI Racing Coach
Advanced analytics
Data sharing and team collaboration
Setup comparison tools

Current pricing is displayed on the subscription page within the Service.

4.3 Payment Terms

Payments are processed by Stripe. We do not store your full card details. Subscriptions are billed monthly or annually in advance. Pricing may change with 30 days' notice.

4.4 Right of Withdrawal

EU consumers have a 14-day right of withdrawal from digital service contracts. By subscribing, you request that the Service begins immediately. You acknowledge that this waives your 14-day right of withdrawal. This notice is displayed at the point of purchase.

4.5 Refunds and Cancellation

Subscription fees are non-refundable except as required by law. You may cancel at any time via account settings; access continues until the end of the paid period.

4.6 Auto-Renewal

Subscriptions renew automatically at the end of each billing period. You will receive a reminder email before renewal. Cancel auto-renewal anytime in account settings before the renewal date.

5. User Data and Content

5.1 Ownership

You retain all rights to your User Data. We do not claim ownership over content you submit to the Service.

5.2 Licence to User Data

By submitting User Data, you grant us a non-exclusive licence to store and process it solely to provide and improve the Service.

5.3 Data Backup

You are responsible for maintaining your own backups. We are not liable for any loss of User Data.

6. Intellectual Property

The Service and its original content (excluding User Data) is the exclusive property of Cottage 13 Katarzyna Brodzka-Demianiuk, operating as MyRacing, protected by copyright and applicable laws. Tire manufacturer catalogues and track databases may include third-party trademarks included solely to enhance user experience.

7. Third-Party Services

The Service integrates with Stripe (payments), Google (authentication), AI service providers (AI Racing Coach), and weather data providers. We are not responsible for third-party services' content, privacy practices, or availability.

8. AI Racing Coach Disclaimer

8.1 Nature of AI Content

The AI Racing Coach uses artificial intelligence to provide recommendations related to motorcycle racing. It is available to Pro subscribers and processes general racing knowledge alongside user-provided data.

8.2 Limitations

AI CAN BE WRONG. AI responses may contain errors or outdated information; the AI has no access to real-time track conditions or your motorcycle's actual state; recommendations are general suggestions that may not suit your specific situation; responses are not reviewed by human experts before display.

8.3 User Responsibility

USE YOUR OWN JUDGMENT. You are solely responsible for evaluating AI recommendations, verifying technical information with qualified professionals, and making your own informed decisions about setup, technique, and safety.

8.4 Not Professional Advice

The AI Racing Coach does not provide professional coaching, certified mechanical advice, safety certifications, medical guidance, or legal advice. All AI content is general educational information only.

8.5 Assumption of Risk

BY USING THE AI RACING COACH YOU ACKNOWLEDGE THAT: you will apply your own judgment to AI suggestions; you assume all risks from implementing AI-generated content; Cottage 13 Katarzyna Brodzka-Demianiuk shall not be liable for any injuries, damages, or losses resulting from reliance on AI content; motorcycle racing is inherently dangerous and AI recommendations do not make it safer.

9. Disclaimers and Limitation of Liability

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Racing Activity Disclaimer

Motorcycle racing is inherently dangerous. The Service provides data management tools only and does not guarantee improved performance or safety. We strongly recommend appropriate safety equipment, professional instruction, and adequate insurance.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COTTAGE 13 KATARZYNA BRODZKA-DEMIANIUK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: THE AMOUNT YOU HAVE PAID US IN THE PRECEDING 12 MONTHS, OR EUR 100.

Nothing in these Terms limits liability in ways not permitted under Polish or EU mandatory consumer protection law.

10. Indemnification

You agree to defend and hold harmless Cottage 13 Katarzyna Brodzka-Demianiuk and its agents from any claims, damages, and expenses arising from your use of the Service, violation of these Terms, or User Data you submit.

11. Termination

11.1 By You

You may delete your account at any time via Profile settings. Your data will be permanently deleted in accordance with our Privacy Policy.

11.2 By Us

We may suspend or terminate your account immediately for breach of these Terms. Where required by law we will provide reasonable notice.

12. Service Modifications

We may modify or discontinue the Service at any time. For paying subscribers we will provide at least 30 days' notice of material changes.

13. Changes to Terms

We will notify you of material changes at least 14 days before they take effect by email and/or notice within the Service. Continued use after changes constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by Polish law, including applicable EU consumer law. Disputes shall first be addressed through good faith negotiation. If unresolved within 30 days, disputes are subject to the exclusive jurisdiction of Polish courts.

15. General

These Terms together with the Privacy Policy constitute the entire agreement between you and Cottage 13 Katarzyna Brodzka-Demianiuk regarding the Service. If any provision is found unenforceable it shall be modified to the minimum extent necessary. You may not assign these Terms without our consent.
